1. Acceptance of Terms

By accessing and using EstateDictate (“Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

EstateDictate is an AI-powered platform that generates professional property descriptions for real estate listings. Our service includes:

  • AI-generated property descriptions based on user-provided property details
  • Photo analysis and enhancement features
  • MLS-ready formatted descriptions
  • Multiple subscription tiers with varying credit allocations

3. User Accounts and Registration

To use our Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Providing accurate property information for description generation

4. Subscription Plans and Credits

EstateDictate operates on a credit-based system with the following plans:

  • Free Plan: 1 standard generation per month
  • Lite Plan: $1/month for 5 standard generations
  • Pro Plan: $29/month for 50 pro generations with enhanced features
  • Custom Plan: Contact sales for enterprise solutions

Credits reset monthly and do not roll over. Subscription fees are non-refundable except as required by law.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Generate descriptions containing discriminatory language or fair housing violations
  • Upload inappropriate, offensive, or copyrighted images
  • Attempt to reverse engineer or copy our AI models
  • Share account access with unauthorized users
  • Use the service for any illegal or unauthorized purpose
  • Interfere with or disrupt the service or servers

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of EstateDictate. The Service is protected by copyright, trademark, and other laws.

You retain ownership of property descriptions generated through our Service and may use them for commercial purposes. However, you grant us a license to use aggregated, anonymized data to improve our AI models.

7. AI-Generated Content

Our AI-generated property descriptions are created based on the information you provide. You acknowledge that:

  • AI-generated content should be reviewed before publication
  • We strive for accuracy but cannot guarantee perfection in all generated content
  • You are responsible for ensuring descriptions comply with local real estate regulations
  • Generated content follows fair housing compliance guidelines

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection, use, and disclosure of your information.

9. Payment and Billing

For paid subscriptions:

  • Billing occurs monthly on the date you subscribed
  • Payments are processed through Stripe, our third-party payment provider
  • You may cancel your subscription at any time through your account settings
  • Cancellations take effect at the end of your current billing cycle
  • No refunds for partial months or unused credits

10. Limitation of Liability

In no event shall EstateDictate, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
